Terms and Conditions of Sale
These Terms and Conditions of Sale create a legal agreement and apply to all orders and sales of services and products concluded between the client and the photographer, Laure Photography, Cattelin Laure.
The photographer reserves the right to modify these Terms and Conditions at any time. Each order is governed by the Terms and Conditions applicable on the date of the order.
ARTICLE 1: PURPOSE
Laure Photography, Cattelin Laure offers private and public photography services as presented on her website.
Booking a session constitutes an order by the client and implies full acceptance of these Terms and Conditions of Sale, except for any special conditions agreed upon by the photographer.
Any other documents, including catalogs, brochures, advertisements, or notices, are for informational purposes only and are non-contractual.
These Terms and Conditions of Sale form an integral contractual document with the service contract signed by the client.
ARTICLE 2: BOOKING
All bookings are confirmed upon receipt of the deposit. A contract will be signed on the day of the session.
If the deposit is not paid within 7 days following the photographer sending the contract, the photographer is not obliged to hold the date.
ARTICLE 3: PRICES AND PAYMENT TERMS
Prices are displayed including all taxes and depend on the rates applicable on the date of the order. If prices change afterward, any previously booked service will retain the price applied at the time of booking.
Travel or accommodation fees may apply and will be included in the contract.
A deposit of 30% of the total amount is required to confirm a photo session and may be paid by bank transfer or cash.
The balance for any service must be paid by the client no later than the day of the service. No retouching will begin without full payment.
Non-payment of the balance will result in the cancellation of photo delivery without refund of the deposit. Final delivery of photos will only occur once the order is fully paid.
ARTICLE 4: SERVICE MODIFICATION
Any request to modify a booked service must be sent to the photographer at least 7 days before the scheduled session.
In accordance with applicable law, the client has a 14-calendar-day withdrawal period starting the day after the order is placed. Any withdrawal request within this period will result in a refund of the deposit, unless the service has already been performed in whole or in part.
In case of cancellation of a confirmed service, the deposit will not be refunded, except in cases of force majeure.
ARTICLE 5: SERVICE DELIVERY
Photographs are taken by Cattelin Laure.
The photographer is not bound by an obligation of result. All efforts will be made to provide high-quality images as specified in the order. The content of these images is at the photographer’s artistic discretion.
Consequently, clients acknowledge that photographs cannot be rejected based on personal taste.
ARTICLE 6: CLIENT OBLIGATIONS
The scheduled session time is strict, and any client delay may reduce the session duration. Sessions may be canceled after 30 minutes of delay, and the deposit will not be refunded.
Clients declare that they are of legal age, freely posing for photos, and authorize any shots of their children according to the style of photography desired.
Photos taken by parents during the session are prohibited unless approved by the photographer or if they represent “behind the scenes” and are sent to the photographer.
Children present during the session remain under the full responsibility of their parents. Any material damage caused by the client, child, or other persons present must be fully reimbursed.
ARTICLE 7: POST-PROCESSING
The photographer never delivers raw images. Post-processing, like photography itself, is part of the photographer’s artistic work and style. The photographer alone decides on the post-processing applied.
Any additional retouching requested by the client will be subject to approval by the photographer, who reserves the right to charge per image according to current rates.
Only photographs processed by the photographer are usable by both parties.
ARTICLE 8: DELIVERY
Cattelin Laure will make every effort to deliver the photos promptly (maximum one month).
Any delay in delivery cannot be invoked by the client to request contract termination, claim damages, or assert any other claim.
Selected and retouched photos are sent via download link to the client’s email.
Digital files are delivered in JPEG format. Other files remain the photographer’s property and will not be provided.
If the client orders prints independently, the photographer cannot be held responsible for quality issues.
ARTICLE 9: STORAGE DURATION
From delivery, photographs are stored under the client’s responsibility. Clients are encouraged to make backups.
The photographer is not liable for loss or deterioration of digital files. Files remain available for 3 months and can be resent if necessary.
ARTICLE 10: LIABILITY
10.1 WEATHER CONDITIONS
The photographer is not responsible for non-performance or partial performance of outdoor services due to adverse weather conditions (storms, heavy rain, etc.).
No refund will be issued; the session will be rescheduled.
10.2 FORCE MAJEURE OR ILLNESS
Force majeure includes any unforeseeable event making the service impossible (accident, death in the family, etc.).
The photographer reserves the right to cancel or reschedule a service due to force majeure or illness. No liability or compensation will be owed. The session will be rescheduled.
For weddings, the photographer will try to help the client find an alternative available photographer. Payments made will be refunded in full, without additional compensation.
10.3 TECHNICAL PROBLEMS OR ACCIDENTS
In case of equipment failure or an accident preventing delivery of the service, the total amount paid will be refunded without further compensation.
In case of loss or damage to photos before delivery (theft, fire, etc.), the client may only claim a refund of the service.
ARTICLE 11: INTELLECTUAL PROPERTY
Even after delivery of digital files, photographs remain the photographer’s intellectual property and are not royalty-free.
Commercial use by the client requires written agreement.
Personal use of photographs (online publication, exhibitions, etc.) must credit Laure Photography.
Clients have printing and reproduction rights for private purposes only unless agreed otherwise.
ARTICLE 12: IMAGE RIGHTS
The photographer reserves the right to use photos for promotion (website, social media, exhibitions, etc.). The client must indicate agreement or refusal when signing the contract.
Refusal does not prevent use of photos where the client is not recognizable. Any publicly shared photo by the client may also be used by the photographer.
ARTICLE 13: PERSONAL DATA
Personal information collected is used exclusively for client management and session follow-up.
The photographer will not share this information with third parties.
ARTICLE 14: GOVERNING LAW
Any dispute related to these Terms and Conditions or associated contracts will, failing an amicable agreement, fall under the exclusive jurisdiction of French courts.
The client acknowledges having read and accepted the above Terms and Conditions of Sale.
